3. Estimate Requests
Submitting an estimate request form does not create a contract or obligate either party. A binding agreement for plumbing, drain, or sewer services only exists when both parties have agreed to a written proposal or service agreement.
Consistent with California Business and Professions Code requirements for home improvement and contractor services, we provide an estimate or proposal describing the work before work begins, except in bona fide emergency situations where immediate action is reasonably necessary to protect health, safety, or property. Estimates provided verbally or by email are good-faith approximations based on the information available at the time. Final pricing is confirmed in a written proposal after inspection of the issue.
4. Service Agreements
All plumbing services performed by Gomez Sewer and Drain is governed by a separate written service agreement or accepted proposal, which will typically specify:

- Project pricing, payment schedule, and any deposit requirements
- Timeline and scheduling terms
- Warranty terms for materials and workmanship
- Change order procedures
In the event of a conflict between these Terms and Conditions and a signed service agreement, the signed service agreement controls.
5. Payment Terms
Payment terms are detailed in each service agreement or proposal. Unless otherwise specified in writing:
- An estimate or written proposal is provided before work begins, as required under California Business and Professions Code for applicable contractor services
- A deposit may be required before work begins, subject to California law limits on down payments for home improvement contracts
- Payment is due upon completion of the agreed work unless a different schedule is stated in writing
- We accept check, ACH transfer, and major credit cards
Overdue balances may accrue interest at the maximum rate permitted under California law. You agree to reimburse us for reasonable collection costs, including attorney fees, if collection action is necessary and permitted by law.
6. Warranty / Guarantee
We warrant our workmanship for the period stated in your service agreement. Manufacturer warranties on parts and materials are separate and are passed through to you directly where applicable. Warranty coverage may be void if:
- The plumbing, drain, or sewer system has been modified or repaired by others without our authorization
- Damage results from events outside our control (flooding, root intrusion after clearance, structural movement, misuse, or improper maintenance)
- Outstanding payment balances remain on the account
Nothing in these terms excludes, limits, or waives any implied warranties that cannot be disclaimed under California law, including warranties that arise under the California Civil Code or the Song-Beverly Consumer Warranty Act where applicable. Our workmanship warranties are intended to comply with California standards for contractor services.
7. Limitation of Liability
To the maximum extent permitted by applicable California law, Gomez Sewer and Drain's total liability for any claim arising from our plumbing services or this website is limited to the amount you paid us for the specific work giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, loss of use, or damage to property not directly caused by our negligence, except where such limitation is prohibited by California law. Nothing in these terms limits liability for fraud, willful misconduct, or other liability that cannot be limited under California law.
8. California Consumer Rights
California law provides consumers with important protections in connection with goods and services. Nothing in these Terms and Conditions is intended to waive rights that cannot be waived under California law, including rights under:
